Terms and Conditions

Please read these Terms and Conditions carefully before using the service operated by Internet Service Providings. The service is defined as the yourcloud.asia website (yourcloud.asia), sub-domains (such as hk01.yourcloud.asia) and the cloud hosting service provided by yourcloud.asia. Your use of this service will constitute your agreement with these terms and your willingness to be bound by them.

If you do not agree with these terms, please discontinue your use of this service immediately.

Definitions

Internet Service Providings is a cloud hosting provider that is based in Taiwan and that operates the yourcloud.asia service from Hong Kong.

Legal Compliance

In storing their data with yourcloud.asia, the customer is required to comply with the local laws of the country the service is provided from. This is currently Hong Kong, but may be expanded in future to include additional countries. It is also the customer’s individual responsibility to comply with the local laws in the country that the service is accessed from. In the event that a customer does not comply with the local laws of the country the service is provided from, Internet Service Providings cannot be held responsible for their actions.

Internet Service Providings strives to operate a service which is safe and secure, and will comply with any reasonable law enforcement request where it is clear that the account is involved with illegal activity.

Liability

In operation of the service, Internet Service Providings will only be liable for a maximum of the cost of the most recent subscription payment, whether monthly or yearly. In the case of professional services, Internet Service Providings will only be liable for a maximum of the total cost of the professional services payment in question.

Intellectual Property

The yourcloud.asia name and logo are property of Internet Service Providings and cannot be used without written permission from Internet Service Providings.

Service Description

The yourcloud.asia service is a cloud hosting service provided by Internet Service Providings. It uses the ownCloud and Nextcloud software to provide file, calendar, contact and task synchronization services, along with additional functionality that can be enabled via the use of plugins. Encrypted web connections are used to synchronize data between customer devices, view the yourcloud.asia website, and use the yourcloud.asia web portal(s).

Although the service could be considered to provide a form of file backup, it should be considered to be more of a file synchronization service, as it does not provide complete protection against file loss. If you overwrite a file on one of your devices with a newer version for example, and the old version is not available through the versioning feature in the yourcloud.asia web portal(s), you may be forced to restore the file from one of your own backups. It is therefore recommended that the customer performs their own backups, which is simple when using the yourcloud.asia web portal(s).

As the yourcloud.asia service is primarily a file synchronization service, it should also be noted that the customer data is not backed-up on a regular basis. Backups are only taken during software upgrades, and limited capacity means that customer data can only be stored for the duration of the software upgrade and subsequent testing. In the event of a complete service failure, the customer will be required to re-upload their data to the yourcloud.asia service. Internet Service Providings will provide the time and resources to restore the service, but the customer will be responsible for re-uploading their data to the service.

As the yourcloud.asia service is designed to be as private as possible, your data is stored on an encrypted file system and data stored on 3rd party services is also encrypted. Your data can only be viewed by you and Internet Service Providings, and not the infrastructure provider or any other service provider between your device and the yourcloud.asia service. It is recommended however that to avoid any loss of access to data stored on 3rd party services, that password recovery is enabled in the yourcloud.asia web portal(s). This enables access to encrypted files to be re-enabled in the event of password loss.

The yourcloud.asia service is aimed at individuals requiring a file, contacts, calendar and task synchronization service, across multiple devices.

Subscriptions

Payments for the service will be taken in a monthly or yearly subscription model, depending on the contract type chosen. Both monthly and yearly subscriptions are available and can be chosen at the time of checkout. If the monthly contract is chosen, payment will be taken on the date of purchase and then monthly on this date. If the yearly contract is chosen, payment will be taken on the date of purchase and then yearly on this date. Payments will be taken automatically by PayPal and the subscription payment will be set up on the initial purchase of the service. Subscriptions can be changed at a later date and be canceled at any time by the customer. If the contract is canceled, then the account on the service will remain active until the payment has expired, at which point the account will be disabled. See Non-payment below for more information.

If the price of the subscription is changed after a customer has agreed to sign up for the service, this change will only apply to new users. Only in exceptional circumstances will a price change be offered to existing users. If a new price is offered to an existing customer and they choose not to accept the change, they are entitled to a refund based on the Refund section below. Any changes in subscription payments will need to be resolved a maximum of 14 days after the customer has been informed of the change, or 7 days after the end of the subscription period, whichever is sooner. In the event that no response is received from the customer and 7 days has elapsed after the end of the subscription period, the Non-payment procedure will be followed, as detailed below.

Professional Services

A variety of additional services can also be provided, as-per the Services page on the yourcloud.asia website. These are provided on an ad-hoc basis, and paid for directly with a one-off payment. Services are charged based on the amount of time required to complete the project, and may also include the price of any materials. Customers are encouraged to contact yourcloud.asia before submitting any payment, and agree the scope and nature of the work required.

Professional services are currently only available to existing customers, but this may be expanded in future.

Non-payment

Non-payment will result in the account on the service being disabled for up to 7 days after the end of the subscription period. As soon as the account is disabled, an email will be sent to the customer, informing them of the action and reminding them that their payment is due. If no payment or contact is received at the end of this 7 day period, the customer data will be deleted from the service and the account will be terminated. If the customer wishes to re-commence service, they will have to sign up for a new account and begin a new subscription to the service. No credit or settings will be carried forward from the previous account and the customer will be treated as a new customer and with a new account. No funds previously paid to Internet Service Providings will be eligible for refund.

Acceptable Use

Use of the service requires acceptance of terms of acceptable use. These are:

  • not to perform any action which would endanger the integrity or security of the service
  • not to perform any action which would negatively affect the use of the service for other users
  • not to use the service for any other reason other than personal cloud storage
  • not to use the service in any way which could negatively affect the Internet community
  • not to synchronize more than 5 devices with one account
  • not to publicly post links for anything other than direct sharing of files with individuals
  • not to use excessive amounts of bandwidth for file synchronization or distribution
  • to keep login details private and not to share them with anyone else who is not a direct customer of yourcloud.asia
  • not to use personal accounts for group use of the service
  • not to share anything that you do not own the rights to.

Non-compliance with the terms of acceptable use will result in a warning and possible termination of the account if the violation continues. In the event of a serious violation of the terms of acceptable use, the account will be immediately disabled and the customer will be informed of the situation. If no contact is received from the customer, the account will be terminated and a refund will be issued based on the Refund policy below.

Refunds

If the customer is using the monthly subscription model and a refund is requested, there is no refund available. The subscription can be canceled through PayPal and the account will remain active until the payment has expired. If the customer is using the yearly subscription model and a refund is requested, only a maximum of 6 months subscription can be refunded. For example, if a yearly contract is chosen and the customer wishes to cancel after 2 months, then 6 months subscription will be refunded. If a yearly contract is chosen and the customer wishes to cancel after 10 months, then 2 months subscription will be refunded.

Refunds for professional services are available, but this will be looked at on a case-by-case basis, and will be based on whether the services have been delivered, as-per the pre-agreed description of the changes. If there is still a dispute after discussions between Internet Service Providings and the customer, a maximum of 75% of the time spent can be refunded, minus any material costs. Internet Service Providings will have the final say on this, and in cases where there is already a commitment to either a monthly or yearly yourcloud.asia subscription, the same refund policy for the subscription will still apply.

If a refund is issued by Internet Service Providings because of a change of contract terms that the customer doesn’t agree with or due to a price change, the same refund policy will apply, except in the case of the yearly subscription, when a maximum of 8 months subscription can be refunded.

If a refund is issued by Internet Service Providings because of a violation of the terms of acceptable use, any costs incurred by Internet Service Providings will be passed on to the customer. If there are no material costs to Internet Service Providings, the same refund policy will apply, except in the case of the yearly subscription, when a maximum of 8 months subscription will be refunded.

Availability

While we strive to provide a service which is fast, reliable and always available, in reality this is not always possible. Factors outside the control of Internet Service Providings may mean that the yourcloud.asia service is unavailable for periods of time. This may be due to a service provider outage, maintenance by the infrastructure provider, or other reasons. Notice of scheduled maintenance by Internet Service Providings will be provided via the usual channels (such as Twitter) and any unplanned outages will be investigated with the infrastructure provider.

Support

Support is provided on a best-effort basis and response times cannot be guaranteed. We aim to respond to each support request within 24 hours of the request being opened, but response times vary and are usually less than this. All support requests should be opened by using either the Contact form or the Support page on the yourcloud.asia website. Please read the Common Questions section on the Support page before submitting your support query, just in case you question has already been answered. Only the official ownCloud and Nextcloud phone, tablet and desktop clients can be supported.

Please see the Privacy Policy for more information on how yourcloud.asia and Internet Service Providings handles your personal information.

Responsibility

The customer is responsible for choosing a secure password and keeping this secret. The customer is also responsible for the configuration of their device, download and installation of any software on that device, and keeping the software on the device up to date. The customer is responsible for providing a valid email address and ensuring that this is capable of sending and receiving emails.

Changes

These terms and conditions may be updated at any time, but the customer will be informed using the usual channels (such as Twitter) and will have 28 days to indicate their disagreement with the changes, after which it will be assumed that the customer accepts and agrees to the changes. If the customer does not agree to the changes, the subscription may be terminated and handled in line with the refund policy detailed above.

Please read this Privacy Policy carefully before using the service operated by Internet Service Providings. The service is defined as the yourcloud.asia website (yourcloud.asia), sub-domains (such as hk01.yourcloud.asia) and the cloud hosting service provided by yourcloud.asia. Your use of this service will constitute your acceptance of these terms and your willingness to be bound by them.

Definitions

Internet Service Providings is a cloud hosting provider that is based in Taiwan and that operates the yourcloud.asia service from Hong Kong.

Personal Information

We only collect the personal information required to operate the yourcloud.asia service. This consists of your name, email address, password (which is encrypted), subscription period, product, PayPal subscriber ID, and storage quota. If you send us an email using a contact form, then your IP address will be sent along with the email. If you purchase professional services from us, then an automatically-generated invoice number will also be stored. No other personal information is stored for any reason, and customer data is only used for the purpose of providing cloud hosting services.

Web Logs

Web logs are generated for every access to the yourcloud.asia website, but contain no personally-identifiable information, other than the IP address of the Internet device that accessed the files, and the files accessed. Web logs for the yourcloud.asia service include the IP address, username and account activity, such as uploading, downloading or changing files. This information is not used for any other purpose other than troubleshooting and maintaining the yourcloud.asia service.

Cookies

Cookies are used throughout the yourcloud.asia website, and are used to provide core website functionaility, as well as useful features to increase the usefulness of the yourcloud.asia website. They are not used to track you between websites, and are only valid for the lifetime of the session, including the subsequent timeout period. If your browser is set not to accept cookies, then it will not be possible to use the yourcloud.asia website effectively.

Cookies are also used by the ownCloud and Nextcloud software in operation of the service. These are un-modified from those included in the software, and are used to provide important functionality. Please see the ownCloud and Nextcloud documentation for more information on these.

Communication

Most information relating to the service will be distributed through the use of Twitter. Any other personal communication will take place via email. Support emails will be sent to your registered email address. Your email address will only be used to send you information that is relevant to the yourcloud.asia service and will not be used for unsolicited marketing.

Security

Reasonable measures have been taken by Internet Service Providings to ensure the safety of your personal information. Your data is stored on an encrypted file system, and all transactions take place over a secure TLS connection. Your password is stored in an encrypted form and is not accessible to Internet Service Providings. All payment processing is handled by PayPal and no payment information is stored by Internet Service Providings. Please remember however, that although reasonable measures have been taken to protect your data, no electronic transmission method or method of storage is completely secure, and Internet Service Providings cannot guarantee its absolute security.

Sharing

We do not share your information with 3rd parties without permission. The only information shared with a 3rd party is ordering information, which is shared with PayPal. The customer uses their own PayPal account to complete the checkout process, and the payment information stays with PayPal. The only information shared with PayPal is the information necessary to complete the order.

Disclaimer

Although every effort has been made to investigate all sources of data collection, due to the complexity of the products used by yourcloud.asia, some sources of data collection may not have been included in this list. Internet Service Providings cannot be held responsible for storage of personal information by 3rd party products, and if Internet Service Providings becomes aware of any other methods of storing personal information that are not currently covered by this Privacy Policy, they will be added to this list.

Changes

This Privacy Policy may be updated at any time, but the customer will be informed using the usual channels (such as Twitter) and will have 14 days to indicate their disagreement with the changes, after which it will be assumed that the customer accepts and agrees to the changes. If the customer does not agree to the changes, the subscription may be terminated and handled in line with the refund policy detailed in the Terms and Conditions.
